Is prank calling legal?
Yes! There is nothing illegal about initiating a prank call to a phone number of your choice in compliance with our Terms of Service. However, as with any telecommunications service, it is illegal and a violation of our Terms of Service to use Prank Call Pro’s services for the purpose of defrauding, harassing, or harming anyone, or to wrongly obtain anything of value. Users are also strictly prohibited from using Prank Call Pro to call emergency lines, healthcare facilities, government agencies, employees or officials, law enforcement, schools, numbers assigned to radio common carrier services, or any service for which the called party is charged for the call. Prank Call Pro uses great caution in crafting phone calls that are appropriate for the scenario you provide, yet benign. For more information, please read our Terms of Service.
What about recording calls?
Some states permit recording with the consent of one of the parties, while other states require the consent of all parties on the call. When a call is placed by a voice actor, the voice actor is a party to that call and must remain on the line through the entire call. The voice actor, as a party to the call, consents to the recording of that call. Prank Call Pro service providers may record telephone calls in those states which only require the consent of one party. However, the following states require the consent of all parties and it is a violation of Prank Call Pro’s Terms of Service to record calls in such states without announcing to the recipient that the call is being recorded: California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Montana, Nevada, New Hampshire, Pennsylvania, and Washington. Any voice actor discovered to be recording calls in all-party consent states without appropriate consent from all parties will be terminated immediately upon discovery of the violation. Prank Call Pro – it’s founders, directors, managers, partners, affiliates, and the company as a whole is not responsible for any legal claims or financial liabilities that may arise if a voice actor violates all-party consent state laws. It is the sole responsibility of service providers to be diligent and avoid recording calls in all-party consent states.
Prank Call Pro allows Caller ID spoofing. Is that legal?
The Federal Communications Commission regulations implementing the Truth in Caller ID Act of 2009 prohibit the transmission of misleading or inaccurate Caller ID information with the intent to defraud, cause harm, or wrongfully obtain anything of value. Prank Call Pro does not intend the calls to defraud, cause harm, or wrongfully obtain anything of value. Users are strictly prohibited from using Prank Call Pro services with the intent to defraud, cause harm, or wrongfully obtain anything of value and doing so is a violation of Prank Call Pro Terms of Service.
What about sharing recordings on social networks?
As discussed in the Prank Call Pro Terms of Service, by posting any recordings made by Prank Call Pro service providers on any forum, social network, media outlets, or any other media channel, you represent that you have the right to post that recording and you release and indemnify Prank Call Pro and it’s service providers from any legal responsibility, claims, or liabilities that may arise as a result of you posting the recording.
